Terms of Service

These Terms of Service ("Terms") govern your access to and use of the YourHOAVote online voting platform (the "Service"), operated by YourHOAVote ("YourHOAVote," "we," "us"). By creating an account, verifying your identity, or casting a vote, you agree to these Terms.
1. The Service
YourHOAVote is a verified online voting platform for homeowner associations. The Service allows boards to schedule ballots, members to vote from any device, and both to receive a tamper-evident audit packet for every certified ballot. The Service is operated to comply with applicable state homeowner-association law, including Pennsylvania's Uniform Planned Community Act and Act 115 of 2022 for associations governed by Pennsylvania law.
2. Eligibility
You may use the Service only if you are at least eighteen (18) years old, are a verified member of an association that has contracted with us, and have completed identity verification through our identity-verification provider. Your association's board determines whether you are in good standing and eligible to vote on any particular ballot.
3. Your account
You are responsible for keeping your email address and mobile phone number current and for maintaining the confidentiality of any access link, magic-link token, or one-time code we send you. Do not share your account access with anyone. You must notify your association or YourHOAVote immediately if you believe your account has been compromised.
4. Acceptable use
You agree not to:
- Cast a vote on behalf of anyone other than yourself or a member who has lawfully designated you as their proxy under your association's bylaws and applicable law.
- Misrepresent your identity, residence, or membership status.
- Interfere with or attempt to compromise the Service's security, including any attempt to bypass identity verification, alter votes, or access another member's account.
- Use the Service to send unsolicited communications to other members.
- Use the Service for any unlawful purpose.
5. SMS messaging terms
If you opt in to SMS notifications, you agree to receive transactional text messages from YourHOAVote at the mobile number you provided. These messages are limited to:
- One-time verification codes during signup.
- Notifications when a ballot opens.
- Reminders before a ballot closes.
- Confirmation receipts when a vote is recorded.
- Notifications when results are certified.
Message frequency varies with your association's ballot schedule. A typical ballot generates two to five messages. Standard message and data rates from your mobile carrier may apply.
You can opt out at any time by replying STOP to any message. Replying STOP unsubscribes you from all SMS notifications, and we will send one confirmation reply. To re-subscribe, reply START or visit your account settings page. For help, reply HELP or email support@yourhoavote.com.
We will not sell, rent, lease, or share your mobile phone number with any third party for marketing purposes.
6. Identity verification
The Service uses Stripe Identity to confirm that you are the named homeowner on a participating lot, as required by Pennsylvania Act 115 of 2022 and similar laws in other states. You authorize us to share the identity information you provide with Stripe Identity and to receive the verified outputs in return. We never view or store the raw images of your government-issued identification. Your association may use the verified outputs to confirm eligibility.
7. Vote receipts and records
After every vote you cast, the Service issues a receipt containing a unique receipt code. The receipt is your legal proof that the vote was cast and recorded. Keep it. The Service retains a record of every vote, every change to a vote, and every certified result as an append-only audit log. Votes cast on the Service are attributable under Pennsylvania law; your association's board can see how each lot voted.
8. Intellectual property
The Service, including its software, design, content, and branding, is the property of YourHOAVote or its licensors. You receive a limited, non-transferable, revocable license to use the Service for the purpose of participating in your association's votes. You may not copy, modify, redistribute, reverse-engineer, or create derivative works of the Service.
9. Disclaimers
The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Your association — not YourHOAVote — is responsible for determining whether any particular ballot complies with its bylaws and applicable law.
10. Limitation of liability
To the maximum extent permitted by applicable law, YourHOAVote and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of one hundred US dollars ($100) or the fees your association paid us for the Service in the twelve months before the event giving rise to the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless YourHOAVote from any claim, liability, damage, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Service.
12. Termination
We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, if your association's contract with us ends, or if required by law. You may stop using the Service at any time by closing your account. Sections that by their nature should survive termination (Vote receipts and records, Intellectual property, Disclaimers, Limitation of liability, Indemnification, Governing law) will survive.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via email at least thirty (30) days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
14. Governing law and venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Allegheny County, Pennsylvania, and you consent to personal jurisdiction there.
